Palm Bay Council Moves to Ban New Medical Marijuana Dispensaries: What It Means for Brevard County

Sponsored by Deputy Mayor Mike Jaffe, the ordinance seeks to streamline local regulations on cannabis facilities by declaring that new dispensaries will no longer be permitted to open in Palm Bay. However, current dispensaries will remain operational, as they will be classified as “nonconforming uses” under the city’s existing code.
As it stands, Palm Bay’s current zoning allows for medical marijuana dispensaries wherever pharmacies are permitted. This means that if the ordinance passes, the city would entirely remove this permission, effectively tightening its regulations. Other nearby municipalities like Melbourne and Melbourne Beach have already imposed similar bans, reflecting a regional trend toward restricting cannabis facilities amidst evolving local sentiments on marijuana use.
The Palm Bay Planning and Zoning Board had previously recommended this ordinance, voting 6-1 in support.
